Off-Sale
- Off-sale intoxicating liquor licenses shall be issued only to premises on which a freestanding building is located for the sale of such liquor
- No off-sale intoxicating liquor licenses shall be issued for a premise(s) that is within 0.75 mile of another off-sale intoxicating liquor facility. Off-sale map (PDF)(Exception: facilities located within the Burnsville Center retail area)
3.2 Percent Off-Sale
- Off-sale 3.2 Percent Liquor License shall permit the sale of beer at retail in the original package for consumption off the premises only
On-Sale
- On-Sale intoxicating liquor licenses require a minimum of 750-square-feet for the dining area portion of the premises and a minimum of 30 seat capacity (same as state law) for Sunday on-sale if applicable
Wine
- An on-sale wine license authorizes the sale of wine not exceeding 24 percent alcohol by volume, for consumption on the licensed premises only, in conjunction with the sale of food. A wine license may be issued only to restaurants having facilities for seating of at least 25 people at a time
- Wine licenses can be applied for on their own, or in conjunction with a 3.2 percent on-sale license to be able to serve strong beer.
3.2 Percent On-Sale
- 3.2 percent on-sale licenses can be applied for on their own or in conjunction with a wine license for the availability to sell strong beer. There is not a separate strong beer license. Establishments that wish to sell strong beer must apply for both a wine license and a 3.2 percent on-sale license and provide proof of liquor liability insurance (Dram insurance).
Renewal
Renew by June 30 annually
Additional Requirements
- New licenses are approved by City Council at a public hearing. City Council meetings are held the 1st and 3rd Tuesdays after the first Monday of each month
- Minimum processing time for new applications is approximately two months
- License applications (new and renewal) require an investigation, which is a separate fee
- Licenses are not transferable
- An inspection from the Department of Alcohol and Gambling is required for all off-sale and wine licenses.
